TERMS FOR ENGAGING THIRD PARTY DELIVERY SERVICES

 

1. Parties and Applicability

These Terms of Use is framed for the Application ‘Bharat Online’ (hereinafter referred to as ‘application’ or ‘App’) and for the website ‘Bharat-online.com’ (hereinafter referred to as ‘website’ or ‘Site’).

The Terms of Use as described herein is applicable to and bind the following parties visiting or accessing this application or website –

a. Lutec India IT Services Private Limited is the Bharat-Online of this Application, i.e. Bharat Online App and website –‘Bharat-online.com’ and reserves all the rights over the App and the website (hereinafter referred to as ‘Owner or  ‘Bharat-Online’ or ‘us’ or ‘we’).

b. The Vendor or the Merchant that has agreed to sign in for the listing under the App and who intends to sell its products or provide its services or both through this App or website to the customers (hereinafter referred to as ‘Merchant’ or ‘Seller”).

c. The person who visits the application or website and agrees or promises to purchase goods or avail services from the Merchants listed on this application (hereinafter referred to as ‘Customer’ or ‘Buyer”).

d. The person or entity which the Merchant engages for delivery of goods sold by the merchant shall be termed as “ Delivery Partner”

(All parties other than the Bharat-Online is referred to as ‘You’)

2. Purpose and Acceptance

This website and the application is owned, operated and provided by Lutec India IT Services Private Limited, (hereinafter referred to as the or “Company” or “Bharat-Online” or “we” or “us”), a Company incorporated under the Companies Act, 2013 having its registered office at Plot No. 35, Gajanan Nagar, Wardha Road, Nagpur MH 440015 IN. By accessing and browsing this site or application which constitutes as the use of this website or application or by using and/or downloading any content from same, you acknowledge that you have read, understood, accepted and agreed the Terms of use that governs the use of this Website or application.

You are hereby requested to please read the following terms and conditions of the website or application carefully as by accessing or using this website or application, you agree to be bound by and accept them in full, the Terms and conditions as given below, the terms of our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or application or to services available through the Site or application.

In the event of you not agreeing to these terms and conditions, you are requested by us, not to access or browse this Website or application or download any materials or content from the Website or application, other than as authorized under this Terms of Use.

The terms of use are formulated to prevent any unauthorized access to this website or application or any unauthorised copying of the materials or content from the website or application.

​3. The Merchant shall have option to chose the Delivery Partner from the options listed on the Mobile App/ website by Bharat-Online. The Merchant hereby understands and accepts that Bharat-Online is only providing the platform for merchant to connect with the Delivery Partner. Bharat-Online shall not be a party to the contract between the Merchant and Delivery Partner. By selecting the Delivery Partner, the Merchant shall enter into the exclusive contract with the Delivery Partner for availing the services provided by such delivery partner at such rate as may be determined by the Delivery Partner and mutually agreed between the parties.

 

4. The Merchant has to abide by the terms and conditions of Delivery Partner for availing his services of delivery. The Merchant shall visit and read such terms and conditions before entering into the contract with such delivery partner.

 

5. The Merchant understands and accepts that the Delivery Partner may make available digital wallet to the merchant for payment purposes. The Merchant shall abide by the conditions of such service of digital wallet. This Contract shall be exclusive contract of providing the Digital Wallet services by the Delivery Partner to the Merchant,  between the Merchant and the Delivery Partner. Bharat -Online shall not be the party to this Contract.

 

6. For all the queries and payment settlement matters, the Merchant shall directly connect with the Delivery Partner. Bharat-Online shall have no responsibility, liability, or any other role in refunds, balance confirmations, payment processing, non-reflection of payments or any other matter related to such Digital Wallet transactions.

7. Disclaimer by Bharat-Online

1. Bharat-Online is only platform to facilitate the connection and communication between the Merchant and Customer. It  is not a Merchant or Customer.

2.  Bharat-online is that of an intermediary in the form of an online marketplace and is limited to managing the website to enable Merchant  to exhibit, advertise, display, make available and offer to sell the products and to enable customer to purchase the products so offered directly contacting the Merchant. No Sale transaction shall be done through or facilitated by the Bharat- Online. Bharat-Online is only a display portal / mobile application to enable the Merchant to display his products and information for sale.

3.  Bharat-Online only provides options to connect with the Delivery Partner for the Merchant. It has no responsibility to monitor the services provided by the Delivery Partner to the Merchant.

4. Bharat Online does not have any interest, financial or otherwise in the transaction between, merchant and Delivery Partner. Bharat-only has only provided a platform to connect the merchant with Delivery Partner and shall not be liable for any claim or litigation initiated by either party against the other party.

The Merchant should refer the “ Terms of Use”  by Bharat-Online before entering into any relationship with the Delivery Partner and availing other services of Bharat-Online.
